1. Services‍

WedDJCo LLC DBA Wedding DJ Co. ("Wedding DJ Co.", "we," "us," or "our") agrees to provide professional DJ services for your wedding or other event (the "Event") as described in the agreed-upon booking form (the "Agreement"). Our services may include, but are not limited to, providing a DJ, sound equipment, lighting, mc services and music for the Event.

2. Booking and Payment

a. A non-refundable deposit is required to secure your booking.
b. The remaining balance is due 30 days prior to the Event.
c. Payments can be made by credit card, debit card, ACH transfer

3. DJ Assignment

a. Wedding DJ Co. reserves the right to assign the DJ that we deem most appropriate for your Event. We will make every effort to accommodate your preferences, but we cannot guarantee a specific DJ.
b. In the rare event that the assigned DJ is unable to perform due to unforeseen circumstances, we will provide a suitable replacement DJ of equal or greater skill and experience.

4. Cancellation and Refunds

a. If you cancel the Event, the deposit is non-refundable.
b. If you cancel the Event within 30 days of the Event, you will be responsible for the full balance of the agreed-upon fee.
c. If Wedding DJ Co. cancels the Event, you will receive a full refund of all payments made.

5. Event Details

a. You agree to provide us with all necessary information regarding the Event, including the date, time, location, and any specific requirements or preferences.
b. Any changes to the Event details must be communicated to us in writing as soon as possible.

6. Music and Playlists

a. You may provide us with a list of songs that you would like played at the Event, as well as a "do not play" list. We will do our best to accommodate your requests and use our professional judgment. Please understand that we are not bound or guaranteed to play every song on the list.
b. The DJ will use their professional judgment to select music that is appropriate for the Event and the crowd.
c. While we welcome your input and song requests, the DJ has the final say in music selection and may decline requests that are inappropriate, disrupt the flow of the event, or do not fit the overall atmosphere.

7. Equipment and Setup

a. We will provide all necessary sound equipment for the Event, and lighting if that option was selected in your chosen package.
b. You and/or the venue are responsible for ensuring that there is adequate space, a table to setup on, and power available for our equipment.
c. Equipment Failure: While we take every precaution to ensure our equipment functions properly, malfunctions can occasionally occur. We may have backup equipment available, but this is not guaranteed. If a significant equipment failure occurs and we cannot provide a suitable replacement, a partial refund may be considered based on the extent of the disruption to the Event.
d. Setup Time and Access: You agree to provide us with access to the venue for equipment setup and breakdown at least 90 minutes before the start time of the Event and 90 minutes after the conclusion of the Event.

8. Venue Requirements

a. You are responsible for ensuring that the venue meets all necessary requirements for our services, including adequate space, power supply, appropriate permits, and any other logistical needs. You are also responsible for any associated costs related to venue requirements.

9. Liability

a. Liability Insurance: Wedding DJ Co. maintains liability insurance to cover potential damages or injuries that may occur during the Event.
b. You agree to indemnify and hold us harmless from any and all claims, losses, damages, liabilities, costs, and expenses (including attorney's fees) arising out of or relating to the Event.  

10. Force Majeure

a. Neither party shall be liable for any delay or failure to perform its obligations under this Agreement due to any cause beyond its reasonable control, including but not limited to acts of God, war, terrorism, labor disputes, and governmental regulations.  

11.  Guest Conduct

a. We reserve the right to stop performing and/or leave the Event if guests engage in unsafe, illegal, or disruptive behavior that interferes with the DJ's ability to perform or creates a hostile environment. In such cases, no refund will be provided.

12. Overtime

a. The agreed-upon fee covers the DJ's services for the specified time period in the Agreement. Any additional time beyond this period is considered overtime.
b.  If overtime is required and has not been pre-booked, the DJ may, at their sole discretion and only if available, can charge an overtime rate. This rate will be communicated to you at the Event and is payable directly to the DJ. Overtime charges are separate from the original booking fee.

13. Meals and Breaks

a.  For Events exceeding 3 hours, you agree to provide the DJ with a meal and appropriate breaks.

14. Governing Law

a. This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware.

15. Entire Agreement

a. This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.  

16. Severability

a. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck from this Agreement and the remaining provisions shall remain in full force and effect.  

17. Waiver

a. No waiver of any provision of this Agreement shall be effective unless in writing and signed by the waiving party.

18. Notices

a.  Agreement to Terms: You acknowledge and agree that by securing the deposit or taking any other action that indicates your acceptance of these Terms and Conditions on our website, you are entering into a legally binding agreement with Wedding DJ Co.

b.  Electronic Communication: You consent to receive all notices and other communications electronically. We may provide notices to you by email to the address you provide during the booking process, by posting notices on our website, or through other electronic means. You agree that all electronic communications meet any legal requirement that such communications be in writing.

c.  Contact Information:  It is your responsibility to keep your email address and other contact information up to date. You can update your information through your account on our website or by contacting us at info@weddingdjco.com.

19. Binding Effect

a. This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective successors and permitted assigns.
